Victoria Smolyar is the founding attorney at Modern Mark. She is a serial entrepreneur on a mission to make legal fun and accessible to the brands she serves.
With 13+ years of experience as a business and trademark lawyer, Victoria leverages the law to help her clients build and scale multiple 6- and 7-figure brands. Her expertise spans trademark and copyright law, with deep work helping business owners secure and monetize their valuable intellectual property. She is also well-versed in business contracts, marketing and advertising compliance, and non-profits.
She frequently writes and speaks on entrepreneurship and the law, offering numerous courses, workshops, and resources for business owners. Not just a lawyer, Victoria is a business owner herself, giving her a unique insight into her clients' needs and ambitions.

Is the matter evaluation really free?
Yes. We review all your information and documents at no charge. If we can help, we'll send a link to schedule a paid Strategy Session. If we can't, we'll let you know and refer you to another attorney when possible.
How much does a trademark cost?
All registration packages are flat-fee. Pricing depends on scope (search, application, classes), and you'll receive an exact quote during your Strategy Session. No hourly billing surprises.
Do you work with non-Texas businesses?
Yes. Trademark and copyright work happens at the federal level, so we serve clients nationwide for IP matters. Business contracts are handled for Texas and New York, and entity formation in nearly every state through our network of corporate counsel.
How long does trademark registration take?
On average, 8 to 14 months from filing, depending on the USPTO's queue and whether your application encounters office actions. We move fast on our end. The wait is largely on the government's side.
What if my application gets rejected?
Responses to non-substantive office actions are included in your registration package. Substantive office actions are handled at a separate flat-fee, and we'll evaluate your odds before recommending one.
What is a Strategy Session?
A 45-minute paid strategy session ($400) where we get to know your business, evaluate your legal needs, and outline next steps. If you engage Modern Mark within a week, we refund the fee.
